The dispute concerns the valuation of an industrial company according to the terms of a share purchase agreement. In the appeal it was successfully argued that the expert appointed by the court had exceeded the margin of discretion when assessing the market share and the profit margin of the company in question. The case was remanded to the court of first instance to take additional evidence and to correct the expert determination on the company value according to the arguments put forward in the appeal. The amount in dispute on appeal was CHF 37 million.
